1. The agreement 1. Sözleşme
These Terms are an agreement between you and Lula Apps ("Lula Apps", "we", "us") about your use of the MySpot app and this website. By using MySpot you accept these Terms. If you do not accept them, do not use the app. Our Privacy Policy explains how we handle data and forms part of this agreement. Lula Apps is the name under which an individual developer publishes apps; it is not a company. Bu Koşullar, MySpot uygulamasını ve bu web sitesini kullanmana ilişkin olarak seninle Lula Apps ("Lula Apps", "biz") arasındaki sözleşmedir. MySpot'u kullanarak bu Koşulları kabul edersin. If you downloaded MySpot from the App Store, your license to use the app is also governed by Apple's Licensed Application End User License Agreement (the "Standard EULA"). These Terms add the rules of the MySpot service on top of it. Apple is not a party to these Terms and is not responsible for the app or its content. 2. Who can use MySpot 2. MySpot'u kimler kullanabilir
You must be at least 13 years old — or older if your country requires a higher minimum age to use an online service or to consent to the processing of your personal information. By using the app you confirm that you meet this requirement and can enter into a binding agreement with us. 3. What the service is 3. Hizmet nedir
MySpot lets two people pair and keep one shared board that appears on the other person's home screen. There is no email or password: your account is tied to a device key kept in your iCloud Keychain. You can also link your Apple ID in Settings to get back to your account on a new phone. If you lose your device without either of these, you lose access to the account. MySpot, iki kişinin eşleşip diğerinin ana ekranında görünen tek bir ortak pano tutmasını sağlar. E-posta veya şifre yoktur: hesabın iCloud Anahtar Zinciri'nde duran bir cihaz anahtarına bağlıdır. 4. Your content 4. İçeriğin
What you put on a board stays yours. We do not claim ownership of it and we do not use it for anything other than delivering it to your partner — except to handle a report, investigate abuse or a security problem, or when the law requires it. You are responsible for the content you create and share, and for having the right to share it — including any photo of another person. Panoya koyduğun şey senindir. 5. Acceptable use 5. Kabul edilebilir kullanım
Do not use MySpot to: MySpot'u şunlar için kullanma:
- break the law, or share content that is illegal where you or the recipient live; yasayı çiğnemek ya da senin veya alıcının bulunduğu yerde yasa dışı olan içerik paylaşmak;
- harass, threaten, or share intimate images of someone without their consent; birini taciz etmek, tehdit etmek veya rızası olmadan mahrem görüntülerini paylaşmak;
- attack, reverse-engineer, overload, or work around the security of the service; hizmete saldırmak, tersine mühendislik yapmak, aşırı yüklemek veya güvenliğini aşmak;
- automate access to the service, or resell it. hizmete erişimi otomatikleştirmek veya onu yeniden satmak.
There is zero tolerance for objectionable content or abusive behaviour. You can report your partner, their board, or a gift note from inside the app (the menu on your partner's board, the Bildir button under a note, or Settings › Partnerini bildir), or by writing to support@lulaapps.com. We review reports within 24 hours and may remove content and end the access of anyone who breaks these rules. Ending your pairing immediately stops that person from sending you boards, gifts, or notifications; this is how you block someone in MySpot. 6. Subscriptions 6. Abonelikler
MySpot Premium is an auto-renewing subscription sold through the App Store. The price and period are shown in the app before you buy, in your local currency. Payment is charged to your Apple Account at confirmation of purchase. It renews automatically at the end of each period unless you turn off auto-renew at least 24 hours before the period ends, and your account is charged for renewal within 24 hours before the end of the current period. MySpot Premium, App Store üzerinden satılan, otomatik yenilenen bir aboneliktir. Fiyat ve süre, satın almadan önce uygulamada yerel para biriminde gösterilir. Ödeme, satın alma onayında Apple Hesabına yansıtılır. You can manage or cancel your subscription in your device's Settings › your name › Subscriptions, or from Manage in the app. Deleting your MySpot account does not cancel the subscription — cancel it separately. Without a subscription, you may be offered the choice to watch a rewarded advertisement to unlock a feature temporarily or to earn coins. Watching is always optional, the unlock is temporary, and we do not guarantee that an ad is available at any given moment. Coins are bought through the App Store or earned by watching rewarded ads, and can only be spent on gifts for your partner inside MySpot. Coins have no cash value, cannot be transferred or exchanged, and do not expire while your account exists. Purchased coins are refunded only by Apple under its own terms. If you delete your account, any remaining coins are lost. 8. Data loss 8. Veri kaybı
Our servers keep only the latest board each of you published; your board history lives on your devices and, if you turn it on, in your own iCloud backup. If you delete the app, reset or lose your device without a backup, or end a pairing, the affected content may be permanently lost. Keep your own copies of anything you cannot afford to lose. Sunucularımız her birinizin yayınladığı yalnızca en son panoyu tutar; pano geçmişin cihazlarında ve açarsan kendi iCloud yedeğinde durur. Uygulamayı silersen, cihazını yedeksiz sıfırlar ya da kaybedersen veya bir eşleşmeyi bitirirsen, etkilenen içerik kalıcı olarak kaybolabilir. 9. Ending it 9. Sonlandırma
You can stop at any time by deleting your account in Settings › Delete account (Delete account), which removes your data as described in the Privacy Policy. We may suspend or end access if you seriously breach these Terms, if we are required to by law, or if we discontinue the service. If we discontinue MySpot, we will give reasonable notice in the app where we can. Ayarlar › Hesabı sil'den hesabını silerek istediğin zaman bırakabilirsin; bu, Gizlilik Politikası'nda anlatıldığı şekilde verini kaldırır. 10. No warranty 10. Garanti yokluğu
MySpot is provided "as is". To the extent the law allows, we do not warrant that it will be uninterrupted, error-free, or that a board or notification will always be delivered on time. Push delivery in particular depends on Apple and on the network, and is outside our control. MySpot "olduğu gibi" sunulur. Yasanın izin verdiği ölçüde, kesintisiz veya hatasız olacağını ya da bir panonun veya bildirimin her zaman zamanında ulaşacağını garanti etmeyiz. Özellikle bildirim teslimi Apple'a ve ağa bağlıdır ve bizim kontrolümüz dışındadır.
11. Limitation of liability 11. Sorumluluğun sınırlandırılması
To the extent permitted by law, we are not liable for indirect or consequential loss, or for lost content. Where liability cannot be excluded, it is limited to the amount you paid us for the service in the twelve months before the claim. Nothing here limits liability that cannot be limited by law, including consumer rights you cannot waive. Yasanın izin verdiği ölçüde, dolaylı veya sonuç niteliğindeki zararlardan ya da kaybolan içerikten sorumlu değiliz. Sorumluluğun hariç tutulamadığı hâllerde, talepten önceki on iki ay içinde hizmet için bize ödediğin tutarla sınırlıdır. Buradaki hiçbir hüküm, feragat edemeyeceğin tüketici hakları dâhil, yasa gereği sınırlandırılamayan sorumluluğu sınırlandırmaz.
12. Changes to these Terms 12. Koşullardaki değişiklikler
We may update these Terms. We will change the date at the top of this page, and for significant changes we will say so in the app. Continuing to use MySpot after a change means you accept the updated Terms. Bu Koşulları güncelleyebiliriz. Sayfanın üstündeki tarihi değiştiririz; önemli değişiklikleri uygulama içinde de duyururuz. Bir değişiklikten sonra MySpot'u kullanmaya devam etmen, güncellenmiş Koşulları kabul ettiğin anlamına gelir.
13. Governing law 13. Uygulanacak hukuk
These Terms are governed by the laws of the Republic of Türkiye, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the service will be resolved by the courts of İstanbul, except where applicable law gives you the right to bring a claim elsewhere. If you are a consumer, you keep the protection of the mandatory consumer laws of your country of residence and may bring a claim in its courts or consumer arbitration bodies; nothing in these Terms limits those rights. Bu Koşullar, kanunlar ihtilafı kurallarına bakılmaksızın Türkiye Cumhuriyeti yasalarına tabidir. Bu Koşullardan veya hizmetten doğan ya da bunlarla ilgili uyuşmazlıklar, geçerli yasaların sana başka bir yerde dava açma hakkı tanıdığı hâller dışında, İstanbul mahkemelerinde çözülür. Tüketiciysen, ikamet ettiğin ülkenin emredici tüketici yasalarının korumasını korursun ve o ülkenin mahkemelerine ya da tüketici hakem heyetlerine başvurabilirsin; bu Koşullardaki hiçbir hüküm bu hakları sınırlamaz.
